AMENDED NOTICE AND ORDER FOR HEARING PURSUANT TO MINN. STAT. 501C.0203

TO ALL INTERESTED PERSONS:

A petition has been filed by Nita Ahlman to obtain a court order setting this matter for an evidentiary hearing to allow for discovery; requiring the Successor Trustee to provide all information regarding Trust assets; requiring the Successor Trustee to provide accountings for the Trust; requiring the Successor Trustee to provide information regarding the administration of the Trust; requiring the Successor Trustee to pursue any unlawful distributions from the Trust, to recover those amounts, and to adjust the final distributions from the Trust accordingly; and awarding Petitioner her attorneys’ fees incurred in bringing this Petition from the Trust.

NOW THEREFORE IT IS ORDERED AND NOTICE IS GIVEN that a hearing will be held remotely on November 16, 2023 at 9:00 a.m., by this Court. The court will notify counsel for Petitioner with further information regarding remotely attending this hearing. If you are not the Petitioner and wish to appear at the hearing, please contact the court by phone at (651) 377-7900 by 4:30 p.m. at least one day prior to the hearing so that arrangements can be made for you to appear.

If you object to the relief sought, you must file a written objection with the court by 4:30 p.m. one day prior to the hearing. In person objections are not currently being accepted. Written objections not filed by the ordered date and time will not be considered. Written objections can be filed with the required filing fee one of three ways: (1) mailed to Dakota County District Court, 1560 Highway 55, Hastings, MN 55033; or (2) electronically filed using the electronic filing system; or (3) placed in the on-site drop box designated for court filings.

IT IS FURTHER ORDERED that notice of the hearing shall be given by mailing a copy of this Notice and Order for Hearing to those qualified beneficiaries of the trust whose identity is known and whose location is known or reasonably ascertainable to the petitioner after making reasonable efforts to locate such persons at their last known addresses by U.S. Postal Service at least 15 days prior to the deadline for an objection referenced above, and publishing this Notice and Order for Hearing one time at least 20 days prior to that date in a legal newspaper of Dakota County, Minnesota. If a qualified beneficiary is a minor or incapacitated, notice shall be given to any representative person in accordance with Minnesota Statutes § 501C.0301 to 501C.0305, acting on behalf of the qualified beneficiary who is known to the petitioner.
