Scully sentenced of sex assault on child

A Vermillion Township man convicted of second degree sexual contact with a victim under age 13 is being held on a 60-day sentence in the Dakota County Jail, which was scheduled to start Jan. 19.
He then will be on supervised probation monitored by Dakota County Community Corrections for 10 years. He is required to register as a predatory offender and attend a sex offender program, as well as submit to polygraph examinations. He also can have no contact to people under age 18 without probation officer authorization, and can have no contact with the victim in the case or the victim’s immediate family.
He was booked into the jail Jan. 9. Scully, 81, resided at 7604 160th St. #3.
The offense occurred in the summer of 2020 when Scully approached a 10-year-old girl in a hammock and started a conversation with her, according to the criminal complaint filed in 2022 in Dakota County Circuit Court. Scully pulled back the girls shorts and touched her, and then masturbated in front of her.
Scully also was convicted of aggravated child molestation in Georgia in 1987.
The incident was reported in January 2022 to the Hastings Police Department school resource officer. The case was investigated by the Dakota County Sheriff’s Office since it occurred within its jurisdiction.
Scully was taken into custody on a warrant in July 2022. He was convicted in a jury trial in August 2023 and sentenced in early January.
Scully’s attorney, Kevin A. Sieben of the Sieben, Edmonds, Miller law firm in Eagan, filed a motion seeking probation only because of Scully’s age, but it was denied.
