Cottage Grove man charged with theft by swindle

A Cottage Grove man was charged Dec. 22 in Dakota County Court for multiple offenses of using a stolen credit card.
Derek Robert Jubinal, 43, was charged with theft by swindle (aggregating) (over $5,000). The felony offense carries a maximum sentence of up to 10 years of incarceration and fines of between $6,000-$20,000.
A home improvement store in West St. Paul alerted police July 14 that Jubinal was allegedly at the store to pick up online order for merchandise paid for with a stolen credited card. A store employee tried to speak with Jubinal about the order, but he left the store without the order, saying he was in a hurry.
Jubinal was arrested by West St. Paul Police later that day. He told investigators that another man reportedly told him he could get him a deal on materials at the home improvement store. Jubinal told police he paid the man directly, and the man placed the order. Jubinal then had to pick the orders up. “The defendant said the thought it seemed ‘shady,’ but he went along with it because it was cheaper,” the complaint states.
Jubinal allegedly told police that the July 14 incident was the first time he had picked up an order placed by the other man. An investigation showed that Jubinal picked up 23 orders paid for with stolen credit cards between June 4, 2025 and July 14, 2025 at stores in West St. Paul, Forest Lake, Fridley, Maplewood, Oakdale and St. Paul. The combined value of the merchandise was more than $30,000.
When investigators presented Jubinal with that evidence, he acknowledged his role in the transactions, according to the complaint.
