A Special Meeting of the School Board of Independent School District No. 200, Hastings, Minnesota, was held on Wednesday, December 20, 2023, at the Hastings ISD 200 District Office in Conference Room A.

The meeting was called to order by School Board Chairperson Lisa Hedin at 9:02 PM.

The following board members were present at the opening of the meeting: Jessica Dressely,

Becky Biessel, Carrie Tate, Brian Davis, Mark Zuzek, Stephanie Malm and Lisa Hedin.

Superintendent Champa was also present.

The item before the board is to move to a closed session pursuant to Minnesota Statutes section 121A.47, Subd.5, which allows the Board to go into a closed session for a hearing on dismissal of a student pursuant to the Public Fair Dismissal Act. Brian Davis made a motion to close the session, Jessica Dressely seconded. The vote was: 7 ayes, 0 nays, motion carried unanimously.

Meeting moved to a closed meeting located in Conference Room A at the District Office at 9:03 PM.

A motion to adjourn from a closed session to an open meeting was made by Brian Davis and seconded by Jessica Dressely. The vote was: 7 ayes, 0 nays, motion carried unanimously.

A motion was made by Becky Beissel to introduce, adopt and waive the reading of the Resolution Expelling the Student and seconded by Brian Davis.

RESOLUTION EXPELLING

A STUDENT

WHEREAS, the administration served written notice of a proposed expulsion upon a student and the student’s parent(s) in compliance with the Minnesota Pupil Fair Dismissal Act;

WHEREAS, the student and the student’s parent(s) received written notification of their rights under the Minnesota Pupil Fair Dismissal Act and elected to waive in writing their right to a hearing on the proposed expulsion;

WHEREAS, the School Board has reviewed the notice of proposed expulsion and the signed “Waiver of Right to Expulsion Hearing” form; Dated 12/20/2023 [Hearing was scheduled for 12/19/23] and

WHEREAS, the written notice of the proposed expulsion, the name of the student proposed for expulsion, and the signed “Waiver of Right to Expulsion Hearing” form are classified as private educational data under the Minnesota Government Data Practices Act;

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. The School Board hereby accepts and adopts the facts and conclusions outlined in the

notice of proposed expulsion as the basis for its decision.

2. The School Board hereby expels the student from the schools of Independent School

District No. 200, Hastings Public Schools, from December 20, 2023 through December 20, 2024.

3. The Superintendent, or a designee, is directed to mail the following to the student and to the student’s parent(s): a copy of this Resolution and a letter stating that the student has been expelled from December 20, 2023 through December 20, 2024 and may apply to resume attending the school in the District the first school day after the period of

expulsion ends.

4. The Superintendent, or a designee, is directed to identify the alternative educational services or special education and related services that are available to the student during the period of expulsion, if the student wishes to take advantage of them.

5. The Superintendent, or a designee, is directed to make an electronic report of this expulsion to the Commissioner of the Minnesota Department of Education within thirty calendar days as required under Minnesota Statutes section 121A.53.

A motion was made by Becky Beisel for the adoption of the Resolution and was duly seconded by Brian Davis. There was a roll call vote and those voting in favor of the Resolution: Jessica Dressely, Mark Zuzek, Brian Davis, Stephanie Malm, Carrie Tate, Becky Beisel and Lisa Hedin. Those voting against: none. Whereupon said Resolution is declared duly passed and adopted.

With no further business, a motion to adjourn the meeting was made by Brian Davis and

seconded by Becky Beissel. The vote was: 7 ayes, 0 nays, motion carried unanimously.

The meeting was adjourned at 9:28 PM.
